Occupancy Agreement for Caretakers at Greenwood Cemetery
Summary:
The City owns a single family home that is located immediately adjacent to Greenwood Cemetery.  The home serves as a residence for the caretaker of the cemetery.  The current caretaker is moving out and staff has identified another candidate to take over the caretaker duties. 

The caretaker will occupy the caretaker residence and provide services such as opening the cemetery gates in the morning and securing them at night, checking the grounds and buildings and performing other duties as set forth in the Occupancy Agreement for Caretaker at Greenwood Cemetery.  In exchange for performing these services, the caretaker shall reside in the residence free of charge. The caretaker shall maintain utilities and insurance on the residence.  The term of the agreement shall commence January 12, 2015 and expire on December 31, 2016.  If the parties agree, the agreement may be renewed for up to two (2) additional terms of two (2) years each and either party may terminate the agreement with 30 days written notice.

Due to the nature of the information contained in the Occupancy Agreement, it is confidential and exempt from public disclosure provisions of the Public Records and Sunshine Laws.

Recommended Action:
Approval and authorization for the Mayor/Pro Tem and City Clerk to execute the Agreement, substantially in the form attached, and approval and authorization, without further City Council approval, for the Real Estate Division Manager to execute the additional renewal options referenced herein, so long as such approvals are in conformance with the terms and conditions of the Agreement, all subject to the review and approval of the City Attorney's Office.
