Ordinance No. 2014-63 Rezoning from NCZ/RP to AC-1/RP for Proposed Madison Hollow Residential & Commercial Development (ZON2014-00025)(Economic Development)

Summary:

The attached ordinance will zone the proposed Madison Hollow multi-family and commercial project, from NCZ/RP to AC-1/RP. The vacant property is located on the west side of S. Kirkman Rd., south of Old Winter Garden Rd. and east of S. Hudson St. The applicant is Stacy Banach, Agent, Parametric Design & Development, LLC, for Doug Doudney, SGD Joint Venture, LLC.

The zoning request is tied to a framework Master Plan (MPL) to develop the 17.3 acre site into a multi-phased age-restricted 320-unit multi-family development, with two commercial parcels on S. Kirkman Rd. The site was previously zoned PD/RP for Kirkman Commons, which was to have been an office/commercial mixed use, but that PD expired in November 2013. The new zoning to AC-1/RP is required prior to the framework Master Plan (and subsequent Specific Parcel Master Plans) taking effect. The underlying future land use designation of the property is Community Activity Center, Resource Protection, so the proposed AC-1/RP zoning is consistent with the future land use designation.

The age-restricted multi-family portions of the Master Plan will be developed in four (4) phases, each with a seven (7) story building with no more than 80 units each. Access will be via a central drive from S. Kirkman Rd. that lines up with the Orlo Vista Post Office entry. The multi-family buildings will be located at least 325 ft. east of the west lot line/S. Hudson St. right-of-way line, and will include a minimum 25-ft. vegetative buffer along the west lot, with either a decorative metal picket fence or wall for added security. An emergency access point may be needed for subsequent phases, to be located either on S. Hudson St. or a small section of Carter St. Other than for emergency access, there will be no vehicular or pedestrian access to S. Hudson St. or to the single-family residential neighborhood (in Orange County) to the west.

The Municipal Planning Board recommended approval of the zoning and framework Master Plan for the Madison Hollow project on October 21, 2014, and the City Council approved those MPB minutes on November 17, 2014.

Recommended Action:

Approve the attached Ordinance No. 2014-63 on first reading and request that the Mayor and City Clerk present the draft ordinance for second reading and public hearing at the next regular City Council meeting.
