Subject:Amendment # 1 to Occupancy Agreement for Caretakers at Trotter's Park (Renewal)
Summary:

Robert Rooney has occupied the caretaker residence located inside Trotter’s Park for several years and provides services to the Park such as checking the buildings and grounds and opening the Park gates in the morning and securing them after the Park closes.  In exchange for his services, the caretaker resides in the residence free of charge.  City staff and caretaker wish to extend the term of the agreement and provide for additional renewal options, all as set forth in the attached amendment.  The term of the agreement shall be extended through December 31, 2016 and may be renewed for up to two (2) additional terms of two (2) years each.  All other terms and conditions of the Occupancy Agreement will remain the same.

Recommended Action:

Approval and authorization for the Mayor/Pro Tem and City Clerk to execute the Amendment, substantially in the form attached, and approval and authorization, without further City Council approval, for the Real Estate Division Manager to execute additional extension options referenced herein, so long as such approvals are in conformance with the terms and conditions of the Agreement, all subject to the review and approval of the City Attorney's Office.
