Amendment No. 7 to Orlando Performing Arts Center Agreement

Summary:
The CITY, CRA and the Dr. Phillips Center for the Performing Arts, Inc. a Florida non-profit corporation formerly known as the Orlando Performing Arts Center Corporation (DPC) previously entered into the Orlando Performing Arts Center Agreement dated June 20, 2007, as amended (the “Agreement”) setting forth the Parties’ agreement relating to the funding, design, construction, development, operation, maintenance and repair of a new performing arts center in downtown Orlando (the “Center”). Amendment No. 7 provides that DPC will be reimbursed up to an additional $751,067.99 from project construction funds for additional costs of Owner's Representative services as a result of the extension of the estimated completion date of Stage 1 of the PAC.  The increased funding will result in less project construction funds available for Stage 2.

Recommended Action:
Approve Amendment No. 7 to Orlando Performing Arts Center Agreement, and authorize the Mayor and City Clerk to execute same, subject to review by the City Attorney's Office.
