Agreement Regarding Dr. Phillips Center for the Performing Arts Plaza Operations and Maintenance and Sales of Alcoholic Beverages and Goods on City Property Managed by the Dr. Phillips Center

Summary:
In 2007, DPC, the City and the CRA entered into an agreement regarding the financing, construction, operation and maintenance of the Performing Arts Center (“Center”), including the plaza area generally located between Orange Avenue and Magnolia Avenue/the Center (Plaza”).   The Agreement Regarding Dr. Phillips Center for the Performing Arts Plaza Operations and Maintenance and Sales of Alcoholic Beverages and Goods on City Property Managed by the Dr. Phillips Center elaborates on DPC’s management of the Plaza, including allowing for DPC’s programming of the area with events and providing maintenance and security 24 hours a day, 7 days a week.   The Agreement establishes the procedures for ensuring adequate police protection and other safety measures for different types and sizes of events in the Plaza.  Additionally, the Agreement allows for the sale of goods by DPC or its agents within the Plaza and Center and allows for the consumption, sale and possession of alcoholic beverages by DPC, its vendors, event vendors or invitees within the Center and within the Plaza during permitted events.   The Agreement also allows for the use of Parcels 3 and 4 (until developed) by DPC for events if approved in advance by the City.  It also provides for Magnolia Avenue, when closed to vehicular traffic, and Parcels 3 and 4, when being used for an event, to be treated as part of the Plaza for purposes of this Agreement.

Recommended Action:
Approval of the Agreement Regarding Dr. Phillips Center for the Performing Arts Plaza Operations and Maintenance and Sales of Alcoholic Beverages and Goods on City Property Managed by the Dr. Phillips Center, in substantially the form attached, subject to review and approval by the City Attorney’s Office, and authorization for the Mayor/Mayor Pro Tem and City Clerk to execute the Agreement.
