Summary:
The City and CNL own property located at 460 Boone Avenue on which the City Commons Parking Garage, "Garage", is located. The Garage consists of approximately 2,219 parking spaces and serves City Hall as well as CNL Towers I and II. Dr. Phillips Center for the Performing Arts, Inc. (DPAC) will operate the Dr. Phillips Performing Arts Center, "Center", located on property owned by the City and located east of Orange Avenue, west of Rosalind Avenue, south of South Street and north of Anderson Street. In conjunction with operation of the Center, DPAC has requested use of a portion of the Garage for parking and pedestrian access. The Center's patrons will self-park in designated spaces in the Garage and then walk from the Garage through the bridge and into the lobby of CNL Tower I, exiting onto Orange Avenue. The attached Agreement provides for DPAC's use of up to 1200 parking spaces in the Garage for each event at a cost of $10 per space, per event. For the first year of the Agreement and only after deducting operation/maintenance costs, DPAC would receive a Discount Fee, not to exceed $250,000.00, from the parking revenue generated by DPAC's use of the Garage. The Agreement also provides authority for DPAC to install certain temporary signage during events as well as DPAC's operation of a livery service between the Center and the Garage. Use of the Garage parking spaces as well as the bridge and the lobby of Tower I will be limited to event days from 6 p.m. on weekdays and noon on Saturday/Sunday to 90 minutes after the conclusion of the event. The Agreement also allows use of the Garage, the bridge and the lobby of Tower I by DPAC personnel to provide security direction, information, and entertainment. All such activities are subject to the review and approval of the City/CNL. |
