Subject:Meritage Homes and City/OUC - Deed and Easements
Summary:Meritage Homes (formerly Cady-Way, LLC) (Developer), the developer/owner of residential property located near Old Cheney Highway and State Road 436 in Orlando (Property), is filing a plat to develop single family homes on the Property.  The City and OUC own a corridor within the Property in which there are underground electric and water transmission facilities, as well as drainage facilities.

In order to implement the Property's development plan, OUC and the Developer have negotiated terms of a Developer Agreement.  The Developer will utilize OUC services on the Property; the Developer and City/OUC will exchange certain real property of approximately the same value; and the Developer and City/OUC will grant each other various easements allowing OUC to carry out operations and the Developer to build in accordance with its approved plat.  None of the property exchanges will impact OUC's ability to access its facilities, nor will the exchanges cause OUC to relocate or move any of its facilities.  The agreement area is located west of Old Cheney Highway and south of Beach Boulevard.

The attached Deed, Temporary Construction Easement and Utility and Drainage Easement are necessary for the real estate exchange and easements.

Recommended Action:Approval of the attached Deed, Temporary Construction Easement and Utility and Drainage Easement and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
