Summary:
The Crownpointe Commerce Park Owners Association (POA) owns property at 7210 Kingspointe Parkway and 4747 West Sand Lake Road. Sections of the City's proposed Shingle Creek Trail for bikes and pedestrians will be located on portions of the two properties (see attached Location Map).
The POA agrees to a voluntary donation of property interests to the City, subject to the terms and conditions memorialized in the Memorandum of Understanding (MOU), Deed, and Temporary Construction Easement (TCE). The City agrees to pay closing costs along with expenses and legal costs incurred by the POA over several years of negotiation. Complete MOU with exhibits is on file in City Clerk's Office as it is too large to attach. |

Recommended Action:
Approval of MOU; Deed, and Temporary Construction Easement, all in substantially the form attached with exhibits; and authorization for the Mayor/Pro Tem and City Clerk to initial and execute the MOU and execute the Temporary Construction Easement; and authorization for the City's Real Estate Manager to execute all closing documents as required; all subject to review and approval by the City Attorney's Office. |
