Subject:
Termination of Developer's Agreements between the City of Orlando and New Earth Properties, LLLP, relating to approximately 8.5 acres of land at 6500 and 6570 Pershing Avenue.

Summary:
In March of 2004, the City of Orlando entered into two Developer's Agreements relating to property on Pershing Avenue. One was between the City of Orlando and property owners Mrs. Erma H. Johnson and Ms. Helga J. Johnson, and related to approximately 4.02 acres of land generally located at 6500 Pershing Avenue. The other was between the City of Orlando and Robert A. Mercer as Trustee of the Mae A. Mercer Trust, and related to approximately 4.43 acres of land generally located at 6570 Pershing Avenue.

Both Developer's Agreements were entered into as a condition of approval of zoning applications for the two properties under which both properties were designated as the R-3A (Low Intensity Residential) district on the City's official zoning maps. Both agreements have two substantive provisions, as follows:

1. A limit on residential density to 10 dwelling units to the acre (where 12 is allowed under the Land Development Code).
2. A prohibition on certain types of rental units.

The current owner of the subject properties is New Earth Properties, LLLP. The new owner is requesting termination of the two Developer's Agreements. City staff recommends terminating the agreements and regulating the future development and use of the properties through applicable provisions of the City's Growth Management Plan and Land Development Code. Termination of the agreements does not constitute development approval. 

 

Fiscal & Efficiency Data: No fiscal impact.

Recommended Action:
Approval of the attached Termination of Developer's Agreement and authorize the Mayor and City Clerk or Mayor Pro Tempore and City Clerk to execute on behalf of the City of Orlando upon final review and approval by the City Attorney.
