Summary:
A portion of Washington Street located west of Eola Avenue was constructed, and has been maintained, as a roadway since the 1920's. However, in order to officially establish the area as right-of-way, the City must file a right-of-way map which will ensure the public's right to utilize the roadway in perpetuity and the City's right to continue its maintenance and repair activities.
Section 95.361, Florida Statutes, provides that a road which has either been constructed and maintained by a governmental entity for four (4) years or maintained by a governmental entity for seven (7) years is deemed dedicated to the public upon the filing of a right-of-way map. |
