Amendment to Temporary Use Permit at 211 S. Osceola Ave./555 Mariposa St. for Jefferson Apartments Construction Laydown Yard and Daytime Vendor Parking (LDC2014-00219)(Economic Development)

Summary:

The owner of the undeveloped lot at 211 S. Osceola Ave./555 Mariposa St. requests an amendment to a previously granted 2-year Temporary Use Permit to allow a 14,900 sq. ft. laydown yard for the future Jefferson Apartments (@ 412-420 E. Church), and daytime vendor parking for functions and events being held solely at The Sanctuary (@ 519 E. Church St.). The subject 1.15-acre property is located on the east side of S. Osceola Ave. and south side of Mariposa St., in the Thornton Park neighborhood. The owner is Jim Katsur, Thornton Commons LLC.

The Jefferson Apartments project was approved by the City Council on 9/23/2013 and will consist of a 9-story building with 300 residential units and ground floor commercial space. It will take approximately 2 years to construct. A separate Temporary Use Permit is being requested to utilize a portion of a separate but adjacent property (at 265 S. Osceola Ave.) for construction worker parking for the Jefferson Apartments.

A Temporary Use Permit was approved by the City Council on 6/23/2014 for the continued use of a semi-improved 0.62-acre valet parking lot at 555 Mariposa St. The amendment would allow 14,900 sq. ft. of the west end of the lot (on S. Osceola Ave.) to be used as a construction laydown yard for the Jefferson Apartments construction. The second part of the amendment would allow daytime vendor self-parking solely for functions and events being held at The Sanctuary. The subject property is zoned PD/T and does not allow permanent principal use parking by right.

The construction laydown area (adjacent to S. Osceola Ave.) will not be prepped and will be cleaned and re-seeded following issuance of a Certificate of Occupancy for the Jefferson Apartments. The proposed daytime vendor self-parking area will be located west of the existing valet parking area and will be con-structed of asphalt millings, same as was done for the valet lot. Bushes, wood posts and private parking signs similar to those already located on the existing valet lot would be installed on the vendor parking lot. Access to the vendor lot will be from existing driveway aprons on Mariposa St. and E. Church St. Other existing driveway aprons will continue to remain chained off to prevent ingress/egress. The new vendor lot will be posted with signage stating that the lot is a private parking area. No overnight parking will be allowed. When the temporary use permit expires, the asphalt millings will be removed and the property re-seeded.

Recommended Action:

Approve the amendment to the Temporary Use Permit for the requested use of the west end of the property as an unimproved construction laydown yard and additional daytime self-parking solely for Sanctuary vendors needing to park prior to 6pm, with the following conditions:

 

·         Consistency - The proposed improvements shall be consistent with the size, dimensions, location and appearance shown on the plan submitted with the current application and as described above.

·         Shrubs/Landscaping - For the added vendor parking, 5-ft. wide viburnum or other similar shrubs, to grow to 30 inches in height and planted every 30 inches on center, shall be planted adjacent to the property line along E. Church St. and extending to the west lot line.

·         Driveways - Vendor vehicles shall use the existing driveways already constructed as part of the previous 7/9/2014 Valet Parking Temporary Use. Remaining existing driveway curbcuts shall continue to be chained off to prevent vehicles from accessing the lot.

·         Construction Laydown Yard - No site prep is required. Once the laydown yard is no longer needed by the Jefferson Apartments, the site shall be re-seeded and returned to its previous state.

·         Permits - All site improvements shall be permitted prior to installation.

·         Duration of Temporary Use - The Temporary Use Permit shall continue to be valid for a maximum 2 years. Said temporary use shall not be used for daily or monthly parking, only for vendor parking for The Sanctuary or valet parking for local businesses or special events. Gravel or asphalt millings shall be removed at expiration of the Temporary Use Permit.
