Maintenance Agreement between City and GDC Verde Master, LLC

Summary:
GDC Verde Master, LLC, "Developer", is the owner of property located at 899 North Orange Avenue, "Property."  The Developer is developing the Property as a 246 unit apartment and retail project, "Project."  In conjunction with construction of the Project, the Developer must install certain landscaping, driveway and sidewalk improvements, "Improvements", within the right-of-way for Orange Avenue.  The right-of-way is owned and maintained by the Florida Department of Transportation, "FDOT", which has issued a landscape permit authorizing the Developer to install and maintain the Improvements.  The City and Developer intend, by this Agreement, to ensure that Developer complies with its construction and maintenance responsibilities under the permit and the City's development approvals.

Recommended Action:
Approval of the attached Maintenance Agreement and authorization for the Mayor or Mayor Pro 
Tem to execute same, subject to review and approval by the City Attorney's Office.
