Summary:
The 2014 Florida Legislature amended the statutory provisions allowing professional sports franchises to qualify for state sales tax rebates to be used for the construction of new sports facilities. The amended statutory language will allow the City to apply for a rebate of state sales taxes expected to be created by the new Major League Soccer franchise, Orlando City Soccer, owned by Orlando Sports Holdings, LLC. Minor modifications to the previously approved Soccer Stadium Use Agreement , Soccer Project Construction Agreement and Non-Relocation Agreement are needed in order to meet specific statutory prerequisites. The agreement amendments extend the initial term of the Facility Use Agreement from 25 to 30 years and makes the Team responsible for repayment of any shortfall should sales taxes not materialize as anticipated or should the Team relocate within the 30 year repayment window and makes the Team responsible to meet other statutory requirements. The fourth Agreement, an Exclusive Intent to Negotiate, is another prerequisite to the application for funding. Council approval will allow the City to proceed with the application process. |

These Agreements should have no additional Fiscal Impact to the City.

Recommended Action:
Approval by City Council authorizing the Mayor and City Clerk or Mayor Pro Tempore and City Clerk to sign these agreements in substantially the attached form, upon final review and approval by the City Attorney, and authorizing the City to apply for the State Sales Tax Rebate funding for the new Soccer Facility and to execute any documents needed to complete this application process. |
