Subject:Ordinance No. 2014-27 Relating to Community Residential Homes; Amending Figures 2A.LDC and 2C.LDC, and Part 1B., Chapter 58, Orlando City Code, to Make Community Residential Homes A Permitted Use In Single Family And Multifamily Zoning Districts As Required By Chapter 419, Florida Statutes; Amending Section 62.200, Orlando City Code, to Amend the Definition of Community Residential Home to Conform to Chapter 419, Florida Statutes (Economic Development)
Summary:

City Staff proposes an amendment to the Land Development Code regarding Residential Care Facilities (RCFs) and Community Residential Homes (CRHs). This amendment is necessary to align City Code with state statutes on CRHs, which supersede city code. It will not change the City’s current policy and practice in reviewing these uses.

The proposed code amendment will clarify that any Residential Care Facility (in the Residential and MXD districts) which meets the state definition of a Community Residential Home shall be a permitted use, subject to the requirements of state law. The amendment consists of adding a footnote to the Allowed Uses table and revising the definition of CRH.

The Municipal Planning Board recommended approval of the item at its July 15, 2014 public hearing. City Council is scheduled to review the MPB minutes in the Consent Agenda section of today’s meeting.

Recommended Action:Approve the attached ordinance number 2014-27 on first reading and request that the Mayor and City Clerk present the draft ordinance for second reading and public hearing at the next regular City Council meeting.
