Summary:
The attached Easement Encroachment Agreement between the City of Orlando and Jefferson Eola, LLC, relates to the proposed development of a 9-story retail and residential building on the downtown block bound by Mariposa St., S. Osceola Ave., E. Church St., and Lake Ave, in the South Eola neighborhood (the "project").
City of Orlando Ordinance No. 2013-49 zoned the project property to Planned Development district (the "PD ordinance"). The PD ordinance requires Jefferson Eola, LLC (the "developer"), to convey to the City a certain City-services and sidewalk easement for the project's street frontage along Mariposa St., S. Osceola Ave., E. Church St., and Lake Ave.
The attached Easement Encroachment Agreement will allow the developer to build and maintain certain subterranean structures (building foundation footers) within parts of the City-services and sidewalk easement. City staff have reviewed the proposed underground encroachments and find that they will not interfere with the purpose of the City easement. The agreement will hold the City harmless from all costs, liabilities, claims, damages, or other expenses associated with the development and maintenance of the encroachments.
