Summary:
The attached ordinance will amend the Official Zoning Map by assigning the
Planned Development (PD) and Planned Development with the Aircraft Noise Overlay District (PD/AN) zoning
designations and creating development standards for approximately ±210.64 acres of property located north of the Osceola County boundary, south of Clapp Simms Duda Road, east of Narcoossee Road, and west of Split Oak Forest.
The Municipal Planning Board recommended approval of the annexation (ANX2013-00008), the GMP amendments to assign the Urban Village and Conservation future land use designations (GMP2013-00016) and add Subarea Policy S.40.2 to the property (GMP2013-00017) and initial zoning of PD and PD/AN (ZON2013-00019) on August 20, 2013.
The annexation was adopted on November 25, 2013.
However the annexation was contested by Orange County. An interlocal agreement (ILA) between the City and County to resolve the annexation issue was approved by the City on March 17, 2014 and by Orange County on March 25, 2014.
The GMP amendments were adopted on March 17, 2014. The first reading of the initial PD zoning was approved on March 31, 2014. Prior to the adoption of the PD ordinance, it was required that a Capacity Enhancement Agreement between the applicant and Orange County Public Schools be adopted. This agreement was adopted on May 13, 2014.
"Section 2 (Land Development Regulations) of the ordinance has been amended to add subsection 1.10 (see line 198) in order to allow an exemption to sections 68.310 and 68.321(f), Orlando City Code, relating to fire sprinklers in single family homes, if alternative mitigation is approved by Council in a future development agreement."
