Amendment to Easement Agreements Between OUC, Quorum Center Associates, and City


Quorum Center Associates owns property located at 4401 – 4307 Vineland Road, "Subject Property." Watkins Associated Industries, Inc., a predecessor-in-interest to Quorum, conveyed three electrical power and/or potable water easements, "Easements,"  across the Subject Property to Orlando Utilities Commission, “OUC”, and the City of Orlando, “City,” from 1983 to 1987.  As development of the Subject Property occurred, buildings were constructed over portions of the Easements.  Since the infrastructure OUC installed was solely for the benefit of the Subject Property, OUC has no objection to amending the Easements to acknowledge that it will not damage or remove any of the buildings in the exercise of its easement rights.  City is simply executing the Amendment as a title owner but is not incurring any obligations.

Recommended Action:
Approval of the attached Amendment and authorization for the Mayor or Mayor Pro  Tem to execute same, subject to review and approval by the City Attorney's Office.
