Summary:
Orange County currently levies a 6 cent local option gas tax on each gallon of motor and diesel fuel sold in Orange County (6 Cent LOGT). The County and City previously entered into an Interlocal Agreement dated April 8, 1997 relating to the distribution of proceeds of the 6 Cent LOGT among the County and municipalities located therein.
The County's levy of the 6 Cent LOGT will expire on August 31, 2015 unless extended. The County proposes to adopt an ordinance extending the tax for an additional 30 years as allowed by law. As a condition to such extension, Section 336.025, Florida Statutes requires the County to reestablish the method of distribution of proceeds of the 6 Cent LOGT pursuant to an interlocal agreement with a municipality representing a majority of the population of the incorporated area of the County. This interlocal agreement sets forth the distribution formula for dividing the proceeds of the 6 Cent LOGT among the County and the municipalities located therein based on each entity's percentage of Orange County's total estimated population as set forth in the statute. The population percentages shall be updated annually each September 1st using estimated population data provided pursuant to section 186.901, Florida Statutes.
Upon the September 1, 2015 effective date of this Interlocal Agreement, the previous interlocal agreement dated April 8, 1997 relating to the distribution of 6 Cent LOGT proceeds shall be superseded and terminated.
