Lease to the Orlando Ballet, Inc. for property located at 610 N. Lake Formosa Drive

Summary:

The City owns property located at 610 N. Lake Formosa Drive currently used as the Loch Haven Neighborhood Center.  The Orlando Ballet recently vacated another city property controlled by OUC and is need of a permanent home.  The Ballet agrees to use the facility to operate a professional ballet company and ballet school and provide, among other things: (a) Dance training and other programs for under-privileged youth and children with disabilities; (b) master classes targeting dance students currently enrolled in Orange County Public Schools; (c) national initiatives with other professional dance companies such as the American Ballet Theatre to introduce dance to the various diverse populations of the City of Orlando and (d) special benefit programs, which shall generally mean programs designed for and offered to City of Orlando residents, which shall include discounts and free performance benefits to residents of the City.  Each year, the Ballet will: (a) have in its school at least two hundred fifty (250) active students, to be further detailed in an Annual Program Plan to be submitted to City for approval; (b) produce six (6) performances annually by the Ballet’s Professional Company, three (3) of which will be presented in the Dr. Phillip’s Performing Arts Center; (c) hold at least six (6) “community outreach programs” to be specified in the Annual Program Plan; (d) hold at least two (2) Special Benefit Programs and (e) hold a minimum of two (2) city-wide open houses to be further defined in the Annual Program Plan, to encourage participation by Loch Haven Park Community Arts neighbors, city residents and neighbors.  The Ballet will also offer at least 10 ballet school scholarships each year based on customary criteria to resident of the City and distribute a portion of any excess tickets to performances to Orlando seniors or youth who might not otherwise be able to attend such events.  

The ballet is required to renovate the existing facility and construct additional space for a total facility size of approximately 22,000 square feet.  As the Loch Haven Neighborhood Center has been used by the public for many years for weddings, class reunions, dances, etc., the Ballet will continue to provide space in the center for these activities.  It is expected that the newly renovated and expanded facility will enhance these private rentals and provide additional funding for the Ballet.  Subject to availability, the City may use the facility up to six time per year at no cost.  The Ballet will be responsible for all costs of utilities, maintenance, security, insurance, construction costs and any other expenses incurred related to the property.  In consideration for the Ballet agreeing to provide these services and make the improvements, the City will lease the property for $1.00 for fifty years, with 2 options for extension, as provided in Orlando Ballet Lease ("Lease"), substantially in the form attached.
 
The location of the property is generally depicted in the Property Description attached. Upon confirmation by the City Surveyor that the survey description accurately depicts the property, the parties shall insert the survey description as Exhibit "A" to the Lease.

Fiscal & Efficiency Data:

This action will have a positive fiscal impact on the City. Last year the City spent $56,000 more on the center (in utilities, supplies, minor repairs and other costs) than it brought in. This pattern was expected to continue this fiscal year and into the future. Additionally, we will be avoiding large potential repairs costs down the road.


Recommended Action:
Approval and authorization for the Mayor/Pro Tem and City Clerk to execute the Lease substantially in the form attached, upon approval by the City Surveyor of the property description, subject also to review and approval by the City Attorney's office.
