Summary:
The attached ordinance revises the City's Sidewalk Cafe regulations by providing more flexibility in the design of certain eating and drinking establishments, namely:
- Providing for alternative standards for the dimension requirements of sidewalks paths adjacent to sidewalk cafes outside of the Downtown (where a 5-ft straight, clear path and additional furniture zone is required), such that sidewalk cafes may be placed 6-ft from the back of curb, 5-ft from any vertical obstruction (utility poles, street furniture, etc), and 4-ft from a horizontal obstruction (handicap ramps, tree wells, etc.).
- Allowing sidewalk cafes to be within the furniture zone, adjacent to on-street parking, in mixed-use planned developments such as Baldwin Park.
- Exempting sidewalk cafes outside of Downtown that derive at least 51% of their gross revenues from the sale of food and non-alcoholic beverages from the barrier requirement (stanchions, railings or other barrier at least 3-ft in height); and exempting all sidewalk cafes in mixed-use planned developments, such as Baldwin Park, from the barrier requirement when the planning official finds that the barrier would interfere with the streetscape design.
All such approvals of sidewalk cafes under the revised standards above are subject to a sidewalk cafe permit reviewed and issued by the permitting official.
