Right-of-Way Encroachment and Maintenance Agreement for 818 E. Church Street
Summary:

The City of Orlando is presently working on stormwater improvements and the reconstruction of Hyer Avenue from Lake Olive north to the intersection of E. Pine Street.  

The property owner of 818 E. Church Street has constructed brick driveway improvements which encroach into the right-of-way of South Hyer.  This encroachment is nonconforming to City code.  Since damage to the driveway approach is anticipated during the construction, the City has agreed to replace the approach, and the property owner will, at its sole cost and expense, maintain and repair the improvements in perpetuity.

Recommended Action:
Approval and authorization for the Mayor/Pro Tem and City Clerk to execute the Agreement, substantially in the form attached, and subject to the review and approval of the City Attorney's Office.
