Summary:
Ordinance No. 2016-32 is for the voluntary annexation for the 3604 W. New Hampshire St. project. The subject property is generally located south of W. New Hampshire Street, east of Parks Oaks Avenue, and west of N. John Young Parkway and is approximately 9.6 acres. The subject site currently has the unincorporated Orange County future land use designation for this property is Medium Density Residential. The County zoning is R-1A. (Economic Development) District 5
The attached ordinance will annex the subject property and assign the City’s future land use designation of Industrial (GMP2015-00031), and associated City zoning of Planned Development in the Wekiva Overlay (PD/W) (ZON2015-00028). Annexation is being requested in order to allow for the development of two communications towers. The subject property is contiguous to the City limits and is reasonably compact. If annexed, the property will not create an enclave.
The Municipal Planning Board recommended approval of the annexation (ANX2015-00015), the GMP designation from the County’s Low-Medium Density Residential to the City’s Industrial future land use designation (GMP2015-00031), the zoning amendment to Planned Development in the Wekiva overlay (PD/W) (ZON2015-00028) on October 20, 2015.
The annexation (ANX2015-00015) and GMP designation (GMP2015-00031) were legislatively appealed and the zoning amendment (ZON2015-00028) was the subject of a quasi-judicial appeal. The hearings for the appeals were held on March 14, 2016 and the City Council upheld the MPB approval of the three items. This PD ordinance was heard by the City Council for its transmittal hearing on March 14, 2016 and has undergone the state review through the Florida Department of Economic Development – Community Planning Division. |
