of legislative appeal of ANX2015-00015 and GMP2015-00031 (Star Communications).

Summary:

Oates Creek, LLC (the "owner"), is the owner of approximately 9.6 acres of land generally located north of WD Judge Drive, east of Mercy Drive, south of W. Princeton St., and west of N. John Young Parkway (the "property"). The owner filed three applications with the City of Orlando relating to the property:

1. ANX2015-00015 - to annex the property into the City of Orlando.

2. GMP2015-00031 - to assign the "Industrial" Future Land Use Map designation to the property.

3. ZON2015-00028 - to assign the "I-P/W" zoning designation to the property.

The purpose of the applications is to permit the development of up to 2 AM-radio antennas on the property. 

The Municipal Planning Board held a public hearing on the application on October 20, 2015, and after the hearing voted to recommend approval of the applications subject to a number of conditions including that the zoning designation be approved as the "Planned Development" district with the "Wekiva" zoning overlay district instead of the "Industrial-Park" district with the "Wekiva" zoning overlay district.

Dr. Wanda Jones (the "appellant") timely filed a legislative appeal of the recommended approval of the annexation and GMP applications and a timely request for a quasi-judicial hearing of the recommended approval of the zoning application.

A quasi-judicial hearing was held on the recommended approval of the zoning application and on February 15, 2016, the hearing officer issued a Recommended Order Denying Petition.

Recommended Action:
Denial of the appeal (approving the application to annex the property into the City of Orlando and to assign the "Industrial" Future Land Use Map designation to the property).
