Amendment to Easement Agreement between City of Orlando, Orlando Utilities Commission and Florida Department of Transportation

Summary:

The City owns an Easement for the benefit of the Orlando Utilities Commission, "OUC", at the northwesterly corner of Sylvia Lane and America Street.  OUC operates America Substation  No. 10, on the Easement Property which serves much of downtown Orlando.  FDOT has constructed, and is constructing, improvements to the interchange of State Road 408 and I-4 which will include the construction of bridges that cross above portions of the Easement Property.  The City and OUC previously granted to FDOT an Air Rights Easement and a Construction/Maintenance Easement for existing and future bridge work within the Easement Property but in order to address an unforeseen site condition related to construction of new bridge work, FDOT has requested that the City and OUC execute the attached Amendment to Easement Agreement.  The OUC Board approved the Amendment on March 8, 2016.

Recommended Action:
Approval of the attached Amendment to Easement Agreement and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
