Sale and Purchase Agreement for Reclaimed Water Distribution System Assets and Easements between City of Orlando, Orange County and City of Winter Garden

Summary:

The City and Orange County own and operate the Water Reclamation Facility known as Water Conserv II, which produces reclaimed water for distribution.  Water Conserv II provides reclaimed water to the City of Winter Garden pursuant to the Winter Garden Agreement for Delivery and Use of Reclaimed Water, dated January 6, 2009.  Winter Garden has requested that the City/County convey to Winter Garden certain facilities, and the easements necessary to operate them, that currently distribute reclaimed water within the service territory of the City of Winter Garden.  City and County staff are in agreement with the proposal.  Transfer of the facilities is at no cost due to the fact that Winter Garden assumes the obligation to relocate and upgrade them.

Recommended Action:

Approval of the attached Agreement and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval of the City Attorney's Office.
