Summary:
The City owns the property located at 756 Bennett Road which includes a building, a paved parking area and a grass overflow parking area. The City leases a portion of the property (the building and paved parking area) to the Orlando Metropolitan Bridge Center (OMBC). The City and OMBC licenses the use of the parking areas to D&E Management Services (D&E) which contracts with the operators of the neighboring property, Gilt Night Club (previously known as Roxy Night Club), located at 740 Bennett Road, to provide additional parking for patrons. This agreement provides additional income to both the City and OMBC and D&E also provides security, insurance and lawn maintenance for the property. The owner of D&E sold its business to the operators of Gilt Night Club in March 2015.
The current Parking License Agreement expires on January 31, 2016 and the parties wish to extend the term and amend other terms as provided in the First Amendment to License Agreement, attached. The term of the agreement shall be three (3) years, commencing on February 1, 2016, and ending on January 31, 2019 and may be extended again for two (2) additional renewal terms of one (1) year each upon mutual agreement of the parties. The license fee, which is equally split between the City and OMBC, shall be $2,800.00 per month (approximately a 10% increase over the previous rate) and shall increase 5% per year. D&E may not assign or sublet the agreement or transfer its interest without the City’s prior written approval and any party may terminate the agreement with ninety (90) days prior written notice to the others. |
Recommended Action:
Approval and authorization for the Mayor/Pro Tem and City Clerk to execute the Amendment, substantially in the form attached, and approval and authorization, without further City Council approval, for the Real Estate Division Manager to execute the additional renewal options referenced herein, so long as such renewals are in conformance with the terms and conditions of the Lease, all subject to the review and approval of the City Attorney's Office. |
