Ordinance No. 2015-40 Amending The Planned Development Zoning District Regulations For The Newton Centre Planned Development, Generally Located To North Of E. Muriel St., South Of E. Harding St., And East Of S. Orange Ave., With An Address Of 2121 S. Orange Ave., And Comprised Of 1.03 Acres Of Land (Economic Development) (Newton Centre PD Amendment, ZON2015-00005)

Summary:

Currently zoned PD/T/SP (Planned Development/Traditional City/Orange Michigan Special Plan overlays), the attached ordinance will amend the existing Newton Centre PD to allow 8,680 sq. ft. of commercial development, specifically 3,800 sq. ft. of eating and drinking use and 4,880 sq. ft. retail use, on Lot 1 of the development.

This PD will be subject to the standards of MU-1/T.  Maximum permitted building heights are three-stories with a maximum ISR of 0.75, all of which is code compliant.

Previous actions regarding this application are as follows:

·         2002– City Council approved a rezoning from MU-1/T and R-2A/T to PD to allow construction of 12 unit townhome development and mixed use building. (ZON2001-00048; CC Doc#: 020401703)

·         2002– City Council approved a PD amendment to allow bonus rooms above the residential garages. (ZON2003-00001, CC Doc#: 030414703)

·         2004– City Council approved a PD amendment amending the development plan for the mixed-use building on the western portion of the site. (ZON2003-00036; CC Doc#: 040126903)

·         2008- City Council approved a PD amendment to modify the development plan and parking layout/spaces, remove office uses, add residential uses and remove the amenity deck. (ZON2008-00023; CC DOC#. 0812151103)

·         2010- Orange Michigan Special Plan adopted by City Council. (CC Doc#: 1008301101)

·         5/2014-MPB recommended approval of a PD amendment allowing a 23 unit townhome development on Lot 1 (ZON2014-00010).  An ordinance was never adopted for this request.

·         4/2015-MPB recommended approval of the subject PD amendment. (ZON2015-0005)

·         9/21/2015-City Council approved the first reading of the attached ordinance.

Recommended Action:
Adopt the attached ordinance number 2015-40 and authorize the Mayor and the City Clerk or Mayor Pro Tempore and City Clerk to execute on behalf of the City upon final review and approval by the City Attorney.
