Termination of Lease Agreement on Communication Tower and Demolition Approval

Summary:

Orange County and the City of Orlando are party to a lease agreement dated March 28, 1978 which authorized the City of Orlando to erect a 150' Communication Tower and related equipment on a portion of Orange County's property located at 805 Capehart Drive.

The City wishes to terminate the lease with Orange County, since the tower is no longer being utilized.  The attached letter agreement from Orange County's Real Estate Manager, Ann Caswell, dated May 26, 2015 outlines our proposal requiring a signature of the City Real Estate Manager, Laurie Botts.  

During the term of this lease, revenue has been split with Orange County - 60% to Orange County and 40% of the revenue to the City of Orlando.  The City has proposed that the demolition cost would be shared in the same manner.

Recommended Action:
Approval and Authorization for the Mayor/Pro Tem and City Clerk to execute the Termination of Lease Agreement substantially in the form attached and approval and authorization, without further City Council approval, for the Real Estate Manager to execute the letter agreement referenced herein, all subject to the review and approval of the City Attorney's Office.
