Summary:
Elan at Audubon Park apartment complex is being constructed at 2901 Davisville St. in Orlando. The apartment land is identified by Orange County Property Appraiser (OCPA) as Parcel 19-22-30-2450-01-000. The property is on the former Orlando Naval Training Center (NTC) off of Warehouse Rd. north of Colonial Dr.; between Lake Druid to the west and Koger Office Center to the east.
The City owns vacant land on Lake Druid, adjacent to the west of the apartment land that is also former NTC property. This City-owned parcel is L-shaped and identified by OCPA as Seabee St., Parcel 19-22-30-2626-01-011.
The apartment land owner is proposing a drainage easement located along the north side of the City land and is a 20 foot wide permanent utility easement. The easement is for stormwater runoff from the apartment project consisting of a 36 inch reinforced concrete stormwater pipe; subject to all required permits issued by the City and the St. John's River Water Management District.
Currently, stormwater naturally sheet flows from the apartment land across the City property down to Lake Druid. The stormwater improvements to the apartment land consisting of lined holding ponds and lined stormwater pipe in the easement area will be a net improvement for stormwater drainage to the lake and the City's park.
The City will receive $20,000 that will be placed in the Orlando Community And Youth Trust to be used for improvements to Lake Druid Park, consisting of shoreline restoration and maintenance or other park related improvements. |

Recommended Action:
Approve Drainage Easement Agreement in substantially the form attached; authorize the Mayor/Pro Tem and City Clerk to execute same; and authorize recording in the Orange County Public Records at grantee's expense; all subject to review and approval by the City Attorney's Office. |
