Summary:
Samir Gazaly, "Owner", owns property located at 7925 St. Andrews Circle, "Property." The City owns a ten foot Drainage Easement, "Easement," along the west side of the Property. A small portion of Owner's house and portions of the pool screen are currently located within the Easement. In order to facilitate Owner's sale and/or refinancing of the Property, Owner has requested that the City consent to the encroachments. City staff have no objection under the limited terms of the Agreement, which provide that the City is not responsible for any damage to Owner's property or improvements and Owner must indemnify and hold the City harmless against all liability arising from the Agreement. |
