Summary:
On October 30, 1995, the City and Orange County entered into an Interlocal Agreement setting forth responsibilities and obligations concerning the design, construction, operation and maintenance of an alum injection treatment system, "System", on property owned by the County, to address urban stormwater pollution adversely affecting Lake Holden. On September 29, 2011, the City and the County entered into a new Interlocal Agreement under which the City assumed primary responsibility for the operation and maintenance of the System since nearly 100% of the stormwater treated by the System originates from within the City's jurisdictional boundaries. This First Amendment provides for the transfer of the System equipment and real property to the City for continued operation and maintenance. |

The System will continue to be operated and maintained from General Fund 0001_F, STW0007_C.

Recommended Action:
Approval of the attached First Amendment and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office. |
