First Amendment To Water Conserv II Lease Agreement With Mid Florida Citrus Foundation, Inc.
Summary:
On June 8, 2009, City Council approved the Water Conserv II Lease Agreement with Mid Florida Citrus Foundation, Inc. (Original Council Agenda Item/Lease attached). 
 
The Foundation desires to extend the lease to allow more time to attract researchers and research investment.  In addition, the City desires to continue the long term relationship with the Foundation and the agricultural community on the Conserv II project.    
 
This First Amendment extends the original term for an additional fifteen (15) years.  Further, as of July 1, 2014, the lessee will begin paying for reclaimed water service for irrigation and other appropriate uses, at rates established by Resolution of the Orange County Board of County Commissioners, pursuant to a separate Customer Service Agreement the parties enter into.

Recommended Action:
Approve First Amendment To Water Conserv II Lease Agreement With Mid Florida Citrus Foundation, Inc., in substantially the form attached; authorization for Mayor and City Clerk to execute same; all subject to review and approval by the City Attorney's Office.
