Summary:
Adventist Health's predecessor-in-interest, Schrimsher Southwest Joint Venture, conveyed a drainage easement, "Easement," to the City in November, 1992. The purpose of the Easement was for the construction and operation of a stormwater pond, "Pond," that would accommodate both private and public water. However, a portion of the Pond, as ultimately constructed, is not located within the Easement. In 1999, certain property, including the Pond site, was platted and the Pond was correctly shown within an easement dedicated on the plat. The owners of the platted property have requested that the City agree to an amendment of the original Easement document to properly delineate the boundaries of the Pond as constructed and thereby remove the title encumbrance. In conjunction with the amendment, the property owner has agreed to formally assume maintenance of the Pond. |
