Subject:
A one year temporary use permit (with two possible one year extensions) for a parking lot located at 48 W. Robinson Street for the Dr. Philips LLC.

Summary:

Dr Phillips City Center LLC, the owner of the existing paved parking lot located 48 W. Robinson Street, has requested a temporary use permit to redesign the parking spaces by installing concrete curbing, restriping the parking area from the current angled parking configuration to a straight parking configuration, and installing parking bumpers at each east side parking space (see the attached letter and site plan). The reconfigured parking lot will add five additional parking spaces (from 24 parking spaces to 29) and will serve their buildings located at 60, 64, 66 and 70 W Robinson as well as 250 N Orange Ave. The reconfiguration of the site will also eliminate the southern egress to the adjacent parking lot and will provide some additional landscaping. 

The site is located within our Downtown Parking Area and is zoned AC-3A/T. It has been used as a parking lot for many years and received a Conditional Use Permit for a bank with a drive through in 1998.

This site is paved but does not comply with the City Land Development Regulations as to landscaping buffers. Also, the Land Development regulations limit surface parking in the Downtown Parking Area to 25% of the required parking. For these reasons, a Temporary Use Permit would be needed to reconfigure the site.

Recommended Action:

Staff recommends approval of this Temporary Use Permit which would allow the reconfiguration of this site as proposed and the use of the site as a parking lot with the following conditions:

  • Consistency The proposed improvements must be consistent with the size, dimensions, site location, and appearance shown on the plans that were submitted with this application and as described above.
  • Temporary Use – Approval is granted on a temporary basis, to expire at the end one year from the date of the City Council Approval. The Owner may request two, one–year extensions by the Planning Official.
  • Sunset – When the Temporary Use Permit has ended, the owner must either secure the site to prevent illegal parking or redesign the parking lot to comply with the full Land Development Regulations.
  • Permits – If approved, the owner will need to seek all required permits from the City’s Permitting Services Division. These permits will need to be in compliance with all other State and Water management regulations.
