Transportation Impact Fee Agreement Regarding Transit Oriented Development between City and Jefferson Eola

Summary:
Section 56.15(I), City Code, provides that any development defined as a Transit Oriented Development (TOD) is exempt from the payment of transportation impact fees to the extent that certain criteria are met.  Jefferson Eola, LLC, is the owner of a approximately 1.83 acres of property at 420 Church Street.  Jefferson is developing the property as a 299 unit multi-family residential (and 10,664 square feet retail) project, "Project".  There are five elements of the City's TOD exemption and City staff have determined that Jefferson meets all five and is therefore entitled to a 100% exemption from payment of the transportation impact fee for the Project.

Recommended Action:
Approval of the attached Agreement and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
